Studio 2 Web Design Terms and Conditions of Service
We do our best to provide an affordable and reliable service. The following outlines the terms and conditions which are set out for our protection as well as yours.
1 - Quotes
(a) Studio 2 Web Design (the 'Business') provides quotes to you (the 'Customer') free of charge. All quotes will be sent by email and a paper quote can be sent via post if required. All quotes will be valid for 60 (sixty) days unless specified.
(b) Work will begin immediately on your website when a valid purchase order number has been received and a deposit has been paid.
2 - Initial Responsibilities
(a) It is the responsibility of the Customer to purchase and register a domain name(s), and a hosting service. The Business is not responsible for these services and work cannot commence until a domain name has been purchased and registered to the Customer.
(b) An existing domain name can be used. A hosting service also needs to be purchased by the Customer. The Business can suggest a hosting service, but if chosen by the Customer, the hosting service needs to have the following available.
- Linux based hosting.
- MySql database (for dynamic websites).
- Minimum 250Mb web space.
- PHP 4/5 compatible.
- .htaccess
- FTP accounts.
- Minimum 10 POP3 email accounts.
- DNS management.
- Firewall protection.
If you are unsure if your chosen host has these services, or don't understand what they are, don't worry! We will guide you through the entire hosting service purchasing process. Unfortunately, we are unable to use Windows based web hosting as our code will not run on it. Our code will only run on a PHP enabled Linux server.
(d) It is the responsibility of the Customer to supply any text, images, colour schemes, layout ideas, product information, contact information, business information etc prior to work commencing. If this information is not available, we may refuse to start work.
(e) It is also the responsibility of the Customer to supply any information relating to the nature of your business or service, to allow us to use this when writing the code to enable good on-page search engine optimisation from the outset.
3 - Agreements
(a) In order for work to commence on your website, we require a valid purchase order number to be emailed to us, a signed copy of the quote, or an email or letter giving us permission to commence with the work. When we receive any of the above, we will send you an invoice for the full amount, of which 50% must be paid as a deposit. This amount is non-refundable. This allows us to plan our time efficiently and it also allows us to produce some draft layouts for your approval.
4 - Payments
(a) We require a 50% payment in advance when agreeing to carry out work for the Customer. This payment is non refundable.
(b) We reserve the right to refuse to undertake any work, including that quoted for, if any deposits have not been paid.
(c) We accept the following methods of payment:
Cash
Cheque (personal or business)
Bank Transfer
Credit / Debit Card (payments from credit / debit cards are subject to a 3% surcharge)
5 - Using this website
(a) The Business has taken care to provide accurate information on this website. We will not be held responsible for any loss of earnings or business arising from using this website.
(b) The websites listed in our directory are checked when published. The Business will not be held responsible for the content or use of these websites. Any material, text, images and all copyright to these materials or otherwise is the responsibility of the website's owners.
(c) The Business has provided a web design and development forum for public use. The opinions expressed in this forum are not that of the Business or anyone connected to the Business. If any post is against the forum rules, it will be removed.
6 - Customer's websites provided by us
(a) The Business will not be held accountable or responsible for any loss of earnings, stock, business or anything else from any use of websites supplied by us. The Business will also not be responsible if any supplied website is used for illegal activities, racism, terrorism, sexism, ageism, or any other offensive acitivity.
(b) Unless a service contract is in place, the Business will not responsible for any supplied website's content, use or operation.
(c) The Business will not be held accountable for any changes made to any supplied websites after it has gone live. We will hold a backup of the final supplied code, as will you, to use in the event of a re-commission. We may charge to re-commission a website where any service agreement is not in place.
(d) The Business will not be held responsible for any loss due to problems with the Customer's chosen hosting company. All questions regarding website downtime should be directed to the hosting company in the first instance.
(e) It is the Customer's responsibility to continue payments to their chosen web hosting company, along with any charges for bandwidth usage, mailboxes, domain names, and any other charges. The Business will not be responsible for any loss due to said charges not being paid.
